1. Acceptance of Terms

By accessing or using CraftBee ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

CraftBee provides AI-powered creative tools that allow users to generate, edit, and enhance images. The Service operates on a credit-based system where each generation consumes credits from your account.

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

4. User Content

4.1 Ownership

You retain all ownership rights to the images you upload ("User Content") and the images generated by the Service. We do not claim ownership of your content.

4.2 License to CraftBee

To provide the Service, you grant us a limited, non-exclusive license to:

  • Process your uploaded images through our AI systems
  • Store your content on our servers
  • Display your content to you within the Service

This license is solely for the purpose of operating and improving the Service.

4.3 Content Restrictions

You may not upload or generate content that:

  • Violates any applicable laws or regulations
  • Infringes on intellectual property rights of others
  • Contains harmful, threatening, or abusive material
  • Contains sexually explicit or pornographic content
  • Promotes discrimination, hate speech, or violence
  • Contains malware or malicious code
  • Violates the rights of privacy or publicity of others

5. Subscription and Recurring Billing

5.1 Subscription Plans

CraftBee offers subscription-based plans with recurring monthly billing. When you subscribe, you agree to pay the subscription fee each month until you cancel.

5.2 Recurring Billing Authorization

By subscribing to CraftBee, you authorize us to charge your payment method on a recurring monthly basis. Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date.

5.3 Lemon Squeezy as Merchant of Record

CraftBee uses Lemon Squeezy as our Merchant of Record for all payment processing. Lemon Squeezy Limited is the authorized reseller of our software and acts as the legal seller of our products. When you make a purchase:

  • Your payment is processed securely by Lemon Squeezy
  • "LEMON SQUEEZY" or "LEMONSQUEEZY.COM" will appear on your bank or credit card statement
  • Lemon Squeezy handles all tax calculation, collection, and remittance
  • Lemon Squeezy manages refunds and billing inquiries on our behalf
  • Your purchase is subject to Lemon Squeezy's Buyer Terms

5.4 Digital Content and Right of Withdrawal

CraftBee provides digital content (AI-generated images and services) that is immediately available upon purchase. By purchasing and accessing our Service, you consent to immediate performance and acknowledge that you will lose your right of withdrawal from this Agreement once you begin using the digital content (e.g., generating images or consuming credits). This is in accordance with Lemon Squeezy's Buyer Terms regarding digital content.

5.5 Credit System

Each subscription plan includes a monthly allocation of credits. AI generations consume credits from your account based on the tool used and settings selected. Credits are reset at the beginning of each billing cycle and do not roll over.

5.6 Payment and Billing Cycle

Subscription fees are charged in advance at the beginning of each billing cycle. You will be charged the same amount on the same date each month. All prices include applicable taxes (VAT, GST, Sales Tax, etc.) as calculated by Lemon Squeezy based on your location. If payment fails, we may attempt to retry the charge or suspend your account until payment is received.

5.7 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. When you cancel:

  • To prevent the next billing cycle charge, you must cancel at least 48 hours before the renewal date, as required by Lemon Squeezy's terms
  • Your subscription will remain active until the end of the current billing period
  • You will continue to have access to paid features until the billing period ends
  • No partial refunds are provided for unused time
  • You can reactivate your subscription at any time

5.8 Refunds

We offer a 14-day money-back guarantee for new subscriptions. For complete refund terms, please see our Refund & Cancellation Policy. Please note that Lemon Squeezy, as Merchant of Record, reserves the right to issue refunds within 60 days of purchase at their discretion to prevent chargebacks.

6. Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service or servers
  • Reverse engineer or attempt to extract source code
  • Use automated scripts or bots to access the Service
  • Resell, sublicense, or commercially exploit the Service without authorization
  • Create multiple accounts to circumvent usage limits

7. Intellectual Property

7.1 Service Ownership

CraftBee and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

7.2 Generated Content Disclaimer

While you own the generated content, we make no guarantees regarding the uniqueness, originality, or non-infringement of AI-generated images. You are responsible for ensuring your use of generated content complies with applicable laws.

8. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. If Lemon Squeezy suspects fraud, refund abuse, or other manipulative behavior, they reserve the right to prohibit you from making further purchases or charge liquidated damages as specified in their Buyer Terms.

9. Limitation of Liability

To the maximum extent permitted by law, CraftBee shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

10. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

11. Indemnification

You agree to indemnify and hold harmless CraftBee and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Chargebacks

You agree to contact us or Lemon Squeezy prior to raising a chargeback or payment dispute with your bank or card issuer. If you dispute a legitimate charge by raising a chargeback without merit or legitimate reason (as determined at Lemon Squeezy's sole discretion), Lemon Squeezy reserves the right to prohibit you from purchasing further products or to charge liquidated damages of $100 USD per incident, as specified in their Buyer Terms.

13. Governing Law

These Terms shall be governed by the laws of South Africa, without regard to its conflict of law provisions. Payment and refund matters are also subject to Lemon Squeezy's terms and the jurisdiction specified in their Buyer Terms.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use after changes constitutes acceptance.
